Ownership

All content on the Nexus by Cara Technology website at http://www.nexusbycara.com (the “Website”) and the associated online learning platform (the “Platform”) is the property of Cara Technology Limited or its licensors, and is protected by United Kingdom and international copyright, trade mark, database and other intellectual property laws.

This includes, but is not limited to:

• All course content: videos, audio, lessons, modules, learning materials, quizzes, assessments, certificates, downloadable resources and reference materials
• Website and Platform design, layout, structure, look and feel, and underlying code
• Branding, names, logos, trade marks (registered and unregistered), product names and slogans, including “Nexus by Cara Technology”
• Text, illustrations, diagrams, photography, video, audio and other visual or audio content
• Methodologies, frameworks, training approaches and the structure in which content is presented

Permitted use

If you have purchased access to one of our courses, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view course content via the Platform for your personal learning purposes during your access period. This licence is subject to your compliance with our Terms and Conditions.

This licence does not give you ownership of any of our content. You may not use our content for any purpose beyond personal learning on the Platform.

Prohibited use

Without our prior written consent, you must not:

• Download, copy, reproduce, duplicate, save or store any course content in any medium, including local devices, cloud storage, personal note-taking applications, or any other system
• Redistribute, share, publish, broadcast, transmit, screen-share or screen-cast any course content
• Record any course content by any means, including screen recording, video capture, audio recording, photography, or screenshots
• Print or transcribe course content
• Make any course content available to any third party, whether for commercial purposes or otherwise
• Modify, adapt, translate or create derivative works based on our content
• Use our content for any commercial training purpose other than your own personal learning
• Remove, alter or obscure any copyright, trade mark or other proprietary notice
• Use images, video or other visual or audio representations of our Products, Platform content or branding for any commercial marketing or promotional purpose
• Use any robot, spider, scraper, automated tool, browser extension or other means to access, monitor, harvest or copy any portion of the Platform or its content
• Reverse engineer, decompile or otherwise attempt to derive the source code, structure or underlying ideas of the Platform

Artificial intelligence and machine learning

We expressly reserve all rights in respect of the use of our content for AI and machine learning purposes. No part of the Platform, no course content, no learning materials, no assessment content, no certificate content, and no other material accessible via or derived from the Platform may, in whole or in part, be used to:

• Train, fine-tune, pre-train, post-train, distil, or otherwise develop any artificial intelligence model, machine learning model, large language model, generative model or similar system
• Prompt, ground, retrieval-augment, contextualise, condition or otherwise inform the output of any such system
• Benchmark, evaluate, test or validate any such system
• Create derivative works that incorporate Platform content into any such system or its outputs
• Be ingested, indexed, embedded or otherwise processed by any system intended to produce outputs that compete with, substitute for, or derive value from our courses or training materials

This prohibition applies regardless of whether the use is for commercial, research, educational, personal or any other purpose. It applies to you and to any third party acting on your behalf or with your authorisation.

Operators of AI training datasets, web scrapers, foundation models and any other automated systems should treat the entirety of http://www.nexusbycara.com and its associated learning platform as opted out of any such use.

Trade marks

“Nexus by Cara Technology”, “Cara Technology”, “AROXA” and “SensCheck”, together with associated logos and branding, are trade marks of Cara Technology Limited. Other trade marks referenced on the Website or Platform are the property of their respective owners.

You must not use our trade marks, logos or branding without our prior written consent, except where expressly permitted by law.

Enforcement

Unauthorised use of our content is a serious infringement of our intellectual property rights and a material breach of our Terms and Conditions.

Where we become aware of unauthorised use, we may:

• Issue formal notices requiring the infringing activity to cease
• Suspend or terminate the offender’s Nexus account without refund
• Notify the offender’s employer where the breach occurred in connection with employment
• Notify hosting providers, search engines, and AI training data operators of infringing content
• Pursue legal remedies including damages, injunctive relief and recovery of legal costs

Reporting infringement

If you believe content from Nexus by Cara Technology has been copied, distributed or used in a way that infringes our intellectual property rights, or if you become aware of any unauthorised use, please report it to us:

Please include as much detail as possible: where the infringing content is located, the nature of the use, any URLs or other identifying information, and the date you observed the infringement.

Requesting permission

If you wish to use any of our content beyond your personal Platform learning licence — for example, to reproduce material for internal training within your organisation, to quote from our materials in publications, or to reference our brand in marketing — please contact us in advance at sales@cara-online.com to request permission.

We consider permission requests on a case-by-case basis. Permission, where granted, will be in writing and may be subject to conditions including attribution, scope of use, and territory.
